1. Introduction
These Terms and Conditions ("Terms") govern your use of the Catica Connect website, client portal, and all services provided by Catica Connect (Pty) Ltd ("Catica Connect", "we", "us", or "our"), a registered South African company operating from 11 Tucana Estate, Cabernet Street, Wilgeheuwel, 1724.
By accessing our website, registering for an account, or purchasing any of our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
2. Definitions
- "Client" refers to any individual or business entity that registers for and/or uses Catica Connect services.
- "Services" refers to all infrastructure, collaboration, digital, and supply chain solutions offered by Catica Connect, including but not limited to FTTH, FTTB, hosted PBX, Microsoft 365, cloud services, and managed IT solutions.
- "Service Request" or "Order" refers to a formal request submitted by a Client through our portal for the provision of one or more Services.
- "Portal" refers to the secure client dashboard accessible at catica.co.za.
3. Services Overview
Catica Connect provides enterprise technology and telecommunications solutions across four pillars:
- Infrastructure Solutions: Fiber connectivity (FTTH/FTTB), dedicated internet access, data centre services, and network infrastructure.
- Collaboration Solutions: Microsoft 365, hosted PBX, VoIP, video conferencing, and unified communications.
- Digital Solutions: Cloud migration, custom software development, cybersecurity, and digital transformation consulting.
- Supply Chain Solutions: Logistics management, inventory systems, procurement platforms, and distribution optimisation.
4. Account Registration
To access certain services, you must register for an account through our portal. You agree to:
- Provide accurate, complete, and current information during registration.
- Maintain the security and confidentiality of your account credentials.
- Notify us immediately of any unauthorised use of your account.
- Accept responsibility for all activities that occur under your account.
We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for extended periods.
5. Service Orders & Pricing
All service requests submitted through the portal are subject to review and approval by our team. Submission of a service request does not guarantee immediate activation.
- Prices displayed on our platform are indicative and may be subject to change based on specific requirements, site surveys, or market conditions.
- Final pricing will be confirmed upon order approval and communicated to the Client before service activation.
- All prices are quoted in South African Rand (ZAR) and are exclusive of VAT unless otherwise stated.
- Monthly recurring charges are billed in advance and due on the agreed billing date.
6. Payment Terms
Payment for services is processed through our secure payment partner, PayFast. By making a payment, you agree to:
- Pay all fees and charges associated with your selected services.
- Ensure sufficient funds are available for recurring payments.
- Accept that late payments may result in service suspension after a 7-day grace period.
- Acknowledge that reconnection fees may apply if services are suspended due to non-payment.
We accept payments via credit card, debit card, EFT, and other methods supported by PayFast.
7. Service Level Commitments
Catica Connect strives to deliver reliable, high-quality services. While we endeavour to maintain maximum uptime, we acknowledge that:
- Scheduled maintenance may occasionally require service interruptions, and clients will be notified in advance where possible.
- Force majeure events, third-party provider outages, or circumstances beyond our control may affect service availability.
- Specific service level agreements (SLAs) may be negotiated for enterprise clients on a case-by-case basis.
8. Intellectual Property
All content on the Catica Connect website and portal—including text, graphics, logos, and software—is the property of Catica Connect or its licensors and is protected by South African intellectual property laws. You may not reproduce, distribute, or modify any content without prior written consent.
9. Privacy & Data Protection
We are committed to protecting your personal information in accordance with the Protection of Personal Information Act (POPIA). We collect, process, and store personal data solely for the purposes of providing our services, managing your account, and improving your experience. Your information will not be shared with third parties except as required by law or as necessary to deliver our services.
10. Limitation of Liability
To the maximum extent permitted by South African law, Catica Connect shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services, including but not limited to loss of profits, data, or business opportunities.
Our total liability for any claim shall not exceed the total fees paid by the Client for the specific service giving rise to the claim during the preceding 12-month period.
11. Termination
Either party may terminate the service agreement by providing 30 days' written notice. Upon termination:
- All outstanding fees become immediately payable.
- Access to the client portal and services will be revoked.
- Any data stored on our systems will be retained for 30 days, after which it may be permanently deleted.
Catica Connect reserves the right to terminate services immediately in cases of Terms violation, fraudulent activity, or non-payment.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the South African courts.
13. Amendments
Catica Connect reserves the right to update or modify these Terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services after any modifications constitutes acceptance of the revised Terms.
